Is it legal to be naked in your backyard?

yesterday me and a few friends were being stupid and decided to do some tanning in the backyard. naked tanning

about 20 minutes in the neighbor yelled over the fence "i called the cops on you". then she stormed into her house.

i haven't heard from the cops but is what we did illegal.

i live in Alberta, Canada

  1. Here in California, a person can be found guilty of indecent exposure if he or she "Exposes his person, or the private parts thereof, in any public place, or in any place where there are present other persons to be offended or annoyed thereby."

    Obviously you will want an opinion from a Canadian attorney.  If the law in your are is like California, it MIGHT be possible to break the law even if you are in your own backyard.  It can depend on many things, such as how visible your yard is from the street.


  2. No not on your own property as long as NO one CAN see YOU!,,, So Mrs Nibby Neighbor can see you so Yes its illegal !! If your fence is too high to where no one can see you then your safe but she's really jealous that she doesnt look that good LMAO!!

    Or maybe her hubby was gonna have a heart attack cuz she caught him looking and drooling!

    But im not sure about Canada, maybe call your local police station an ask them, its not gonna hurt anything! But here in the states we got to have a pretty big privacy fence! lol

  4. was the fence a privacy fence? If you were in an enclosed area where you couldn't been seen from the street or neighboring property without someone trying to peep through the fence you are ok. if it was a chain link or some other fence not designed for privacy then it is public indecency.

There would be nothing wrong with that in California, as long as you are not visible from a person standing in a public area.  If a person needs to climb a fence to see you, then it's their problem, not yours.  So, I would imagine that because Canada is more enlightened than the U.S. when it comes to the naked body, then what you did is *probably* OK.

    Note to SoCalAttorney:  You missed the single-most important adverb in the definition of indecent exposure - "lewdly."  Tanning is not lewd.

    In Canada it is NOT against the law to sunbathe in the nude in your own back yard; However,

         According to the Canadian Criminal Code pertaining to nudity; If the indecent Act was in a PUBLIC place in the presence of one or more persons OR in any place with INTENT to insult or offend any person is GUILTY of an offense punishable on summary conviction.

         SUNBATHING: Nude sunbathing is NOT of sufficient moral turpitude to support a charge for doing an indecent act.

  9. If your back yard abutted the school playground, then probably.  If your back yard is surrounded by a six foot wooden privacy fence, then probably not.
