Is it legal to drive a forklift while smoking?

It depends on the state laws where you live, A lot of states don't allow smoking in the work place.

It may be "legal", but against Workers' Compensation Rules or Union Regulations.

This really brings up two issues;

1. Workplace safety

2. Working conditions for others

As stated above it will depend on your location and what you are moving as well and at our workplace it is not illegal but it is not accepted because of safety issues......

In many states, it is not.  Smoking in the workplace in any enclosed space is prohibited.

In my city, it's illegal if you are inside a restaurant or a grocery store.
