Is it legal to force a salaried employee to work more than 40hrs per week and get paid for no over time?

I am a salaried employee and I am getting paid for 40hrs a week though I am forced by my employer to work usually 60-65 hrs every week.Is this legal??

    If you are "salary"......probably the answer is yes.

  3. if you are salaried then yes...its like ur pretty much paid for any amount of hours your job takes to complete, but it depends on if you are exempt or non-exempt...read more below

    The Fair Labor Standards Act (FLSA) requires employers to pay employees overtime (1 1 2 times their regular rate of pay) if they work over 40 hours ( 29 CFR 541 et seq. ). Employees can be paid on an hourly or a salary basis. If they are paid on an hourly basis, they are nonexempt--always. However, if they are paid on a salary basis, they can be either nonexempt or exempt. This is an important distinction that many employers often misunderstand. While the majority of salaried employees are categorized as "exempt" and therefore exempted from overtime, some employees are paid on a salary basis, classified as "nonexempt," and are not exempted from the overtime requirements of the FLSA.

Usually not.  It depends on whether you are "exempt" from the federal Fair Labor Standards Act.  Some supervisory and management employees are exempt if they make at least a minimum amount per year, and some professional jobs are exempt.  Other than that, just being "salaried" doesn't mean they don't have to pay you overtime.  See http://www.dol.gov/dol/topic/wages/overt... for more info.

  6. Oh yeah. My stepmother makes a GREAT salary when you think of it as 9-5. But she usually works 11-12 hours a day and many weekends. She does not get anything extra. The perk of her job is that she can come in late if needed and she gets flexibility with vacations. But, she works a LOT of hours. There is no overtime with salaried employees.
