Question:

Is it legal to have liquor in my own room when my roommate's on probation?

So I'm renting out a room in a house with a man who's on probation. He's not allowed to have alcohol in the house but can I have liquor in my own room as I pay to live their?

(and yes, I'm over 21.)

  1. You can't break the law but you're forcing him to break the law. If you two live together and you have liquor, your roomate is breaking the law. Solutions:

    A. Don't bring liquor into the house

    B. You or your roommate move out

    C. Risk it but if you caught the fact that he claims the liquor is yours may or may not hold up whether its true or not.

    If you can, try A. You can still drink at a bar or a friend's place without being a b*****d to your roommate.


  2. It's legal for you to have liquor, but whether it's legal for him to be that close to it is something he should ask his parole officer.

Because you are renting from him, he is your landlord.  If you have alcohol in your room in the same house he lives in, then you will get him in serious trouble if caught.  If this condition happened after you already signed a lease, he can still give you a 30 day notice to move for the alcohol as it is court mandated that he cannot be around it, and any judge would uphold the eviction (or request to move) as he owns the house.

    So, work with him on this.  Go to a bar to drink and dont bring any home, unless you want to live somewhere else.  Because if he goes to jail for probation violation, you lose a place to live.

  4. Depends on the terms of his probation in terms of his keeping distance from liquor.  In general if you keep it locked up and lock your bedroom door it shuoldn't be an issue...not only that why do you care--it's his problem not yours...if he's not supposed to be NEAR it than he should be asked to move.  Your freedom needn't be hindered by another person's mistake.  PEACE!

  5. The problem is, he can still be charged with a probation violation because he cannot be AROUND alcohol.

  6. You will be SERIOUSLY jamming him up if his parole officer wants to s***w with him. I would contact the PO and ask him what he allows. Maybe if you keep in it a locked footlocker or something it would be ok.

    But really, man, just pop into the local bar if you need a drink that bad.
