Is it legal to hunt with a sks in texas?

i am thing of buying a semi-automatic sks to use for deer season but someone told me it might be illegal to hunt with a semi-automatic i will be hunting in texas and ohio is it legal or not

    Firearms

    Game animals and game birds may be hunted with any legal firearm, EXCEPT:

        * white-tailed deer, mule deer, desert bighorn sheep, and pronghorn antelope may NOT be hunted with rimfire ammunition of any caliber.

        * shotguns are the only legal firearm that may be used to hunt Eastern turkey during the spring Eastern turkey season (see County Listing). Rifles and handguns may not be used to hunt Eastern turkey.

        * pellet guns and other air guns are NOT LEGAL.

        * fully automatic firearms are NOT LEGAL.

        * firearms equipped with silencers or sound-suppressing devices are NOT LEGAL.

        * a shotgun is the only legal firearm for hunting migratory game birds and lesser prairie chicken (see Definitions - Legal Shotgun).

    Nongame Animals (Non-Protected): Any lawful firearm, pellet gun, or other air gun is legal.

    Magazine Capacity (number of shells/cartridges allowed): There are no restrictions on the number of shells or cartridges a legal firearm may hold when hunting game animals or game birds (except migratory game birds, see Legal Shotgun).

    So yes you can use an SKS

In Texas you can hunt deer with a semi-automatic provided that it is a center-fire and that it is equipped with a 5-round magazine only.  That means a magazine that is made to only hold five rounds, not a 30 round magazine that only has five rounds in it.  So ask the vender about legal hunting magazines for your semi-auto.

    ADDENDUM:  Apparently the ammo capacity for hunting anything but migratory bird is now a thing of the past.  Only shotguns used to hunt migratory bird have an ammo limit.  So you should be okay with your SKS, as for deer it only stipulates that you can't use rimfire.

  4. No. It is not illegal to hunt with an SKS 7.62 x 39 mm rifle. You will just have to carry a 5 round capacity magazine with you whenever you go hunting. Texas law only prohibits hunting with high capacity magazines and rimfire .22 ammo. Your SKS rifle is a centerfire semiautomatic rifle, and yes it can be used for hunting here in Texas. My friend Robert has hunted wild hogs with his SKS and it is a very good rifle.

  5. yes. i hunt boar all the time with my sks on my property in Coldsprings. And baor season is always open.

  6. Check with the Texas Parks and Wildlife Warden Service for magazine capacity restrictions. The semi is no problem.
