Question:

Is it legal to not pay commission based on a monthly service sold?

I sell services that are billed out monthly. I was under the impression when I started work for this company, that commission would be paid for each account that I set up. Now, after working here for awhile, and asking where my commissions are, I am being told that they only pay on the first month only. Is that legal? Stupid me didn't get anything in writing, so I just want to see if I have any recourse. It seems to me, that due to the work I've done to bring in a client who continues to pay monthly, that I should be compensated monthly. I guess I could just sign people a new contract each month and see how they like that...

  1. If you didn't clarify the commission structure before you started work, and didn't get it in writing, you are out of luck.  If they said they pay for each account you set up, it would have been reasonable to think you'd just get paid once for each account.
