Is it legal to put 'clean driving licence essential' in a job advert?

  4. I believe so. In looking for jobs I always see "Clean driving record required" for jobs where a license is essential (truck driver, delivery person, transporting the elderly, etc).

  6. If it is a true job requirement.  For instance, I worked for a city that couldn't hire you if your driving record had many dings on it because the company that insured the city's vehicles wouldn't cover those bad drivers.

  7. Does any 'minority' group have to have points on their licenses? Can't see it discriminating if the job requires the need to drive.

    This is something that is commonly posted as a requirement for jobs where you are expected to drive, so they want drivers who have a proven record of driving in a safe, legal manner.  

  9. I could possibly infringe the DDA and potentially age discrimination laws. If the job has a genuine requirement that employees must drive (to attend meetings, transport people/items etc) it is perfectly legal. If it is a dirty tactic to avoid attracting disabled or very young people then obviously it is discriminatory.

  10. Yes it is.  If they need a clean driving record for the position, why waste some applicant's time that has not that qualification.

  11. It's not an illegal, because it only impacts on the firm's insurance rates - you're not implying that any race or age has more accidents or tickets.

  12. Yes, because if the job entails driving a company car, insured by the company, then the company has to give that confirmation to the insurance company.

  13. Of course it is legal.  Not only is it legal, but in many, many jobs it is "essential" if there is absolutely any driving required in the job description.  

    Why should an employer pay higher auto insurance for their employee's driving worker?

    Why should an employer place their clients at risk if their employee transports clients?

    I think that rather than going "against the spirit of the DDA", it upholds it!  The DDA does not support poor behavior behind the wheel, or placing others at risk.
