It is ONLY illegal if the not US allies including Al Qaeda and their sub division organizations buys it. I guess.

Selling any military equipment over the Internet on such places as eBay to ANY unauthorized personnel is illegal and in some cases can be punishable by law.

If it is actually his personal property then I don't see why it would be illegal. But since it was (or maybe still is) a military item I wouldn't buy it just incase this person is lying and has actually stolen it. If he did steal it and you bought it you could be charged with receiving stolen merchandise.
