Is it legal to sleep in your car overnight at a highway rest stop?

Let's assume that the driver in this example is a male traveling alone. He is sober, but too poor (or too cheap) to pay for a motel room. Or maybe there aren't any decent hotels anywhere nearby....are the police gonna come tapping on your window thinking that you're drunk, or ticket you for loitering???

Second part to this question:

Okay, let's say you're driving on a really remote stretch of highway (somewhere like eastern Montana or New Mexico). You can't find a rest stop, or the closest one (that you know of) is too far away and you're too tired to continue driving. Is it okay to pull over to the side of the highway (assuming that there's a breakdown lane of course) and call it a night?

  1. Yes it is legal to sleep in your car at a rest stop.

    As far as sleeping a long side of a road that all depends on how far that you can get off the road way.
