Question:

Is it my fault if a girl darts in front of my car while i'm driving and i hit her?

i'm driving in the parking lot at 10mph and i come across a teenage girl who runs across my car and i almost hit her. she was only 5 feet away. she came from around a big van and just ran across my car without looking before crossing. then she had the nerve to yell at me, but i just yell back at her to learn how to cross the street. gosh d**n teens.

  1. Sad to say, the argument that likely will be made in such a case is that you were driving too fast for conditions, even if you were driving at 10 mph. The reasoning would be that you should have anticipated that someone could have been ready to dart out from a large object that obstructed your vision.

    If it was dark, or the weather was bad or if you had anything in your system stronger than an aspirin, it would just be worse.

Probably would turn out that way.  It seems to me that people seem to think everyone is to watch out for them----and they can just do or walk wherever they please.  Another thing that gets me angry is idiots that walk on the wrong side of a road (with their back to the traffic).  If they get hit (or worse) the auto driver is prosecuted and fined.  I read it all the time in the papers. When I was a kid, cops used to stop and tell you to get over on the side of the road facing oncoming traffic or get off the road entirely. Parents and schools instructed kids of the law of the road also.  And bike riding---Rules and laws are the same as for an automobile.  But today----It's do as you please.

      So, yeah, I believe you would have been found at fault.

  3. Sadly it would have been your fault, but that irritates the c**p out of me. Weren't people taught "look both ways" when they were little?

  4. Yes it probably would have been your fault because it was the front end of your vehicle that would have struck her. You are always supposed to halve control over your vehicle.  But in some cases it should not be the case.

  5. as long as you were driving at a reasonable speed.  Just like when an animal darts out in front of you when driving down the highway.  If someone just comes out of no where and runs in front of you, then it cannot be your fault.  How can you be expected to stop?
