Typical when adopting aboard there is not reclaim period. Most of the babies/children have been abandoned already or are living in orphanage. That’s one reason some people opt to go outside the USA because they don't have to worry about a reclaim happening.

If you are asking this, then I don't think you are really mentally prepared to adopt a child.  with all adoptions there is going to be a chance that the child/adult wants to search for their birth family.  If you are worried about this now, what are you going to do then?

You're usually 'safe' because you'd be taking advantage of a poor, desparate woman who has few resources.

It takes so long for the adoption to go through that I am sure the mother would not want the child back.  My aunt adopted two children from Russia and she had to make 2-3 visits there before she could take them home.  It takes months. She adopted them 2 yrs apart. It was very expensive also.  I believe it was over twenty thousand per child.

No - once an international adoption takes place, the mother cannot take her child back.  However ... if the adoptive parents are not happy with the child, they can return it to the country of origin, i.e. they have the "right" to disrupt the adoption and send the child back to the orphanage.  Yes - it does happen.

Added - to person above me - oh my - what a lucky child to be taken fron his/her country of origin and then to be bounced from one family to another.  Hey, at least it is not the orphanage.  Oh yes - welcome to amerika.

What if the mother could reclaim her child after 6 months? Would you not be willing to support her and the child of your dreams in order for the 2 of them to stay together? I mean, this is the child of your dreams, the one you would give anything to, why not give him or her a chance to grow up with his or her natural family? Would you rather pay $$$$ to get a kid or are you philosophical enough to pay $$$$ to support a family that is poor? Think about what you are doing.

The answer is yes..if u adopt a child in Internationl..within 6 months if the birth mother decided to take the baby back..it will happen ,she can get it back but once it legalize the papers..u are okey but that's a rare case only..happens once in a great while..

The way you phrase the question you make it seem as if it's a bad thing for a child to go home to his or her real family.  Many adoptees long for their mother to come for them...that would be something to celebrate.

When the child is legally yours depends on the program.  I have not heard of any international program where the adoption is not final before the adoptive parents have custody of the child.  In the program we used, after we got our referral the birthfamily still had the opportunity to decide to parent through the whole court process.  Once the court process in the foreign government was over, their rights were terminated and we were allowed to travel for our daughter.  In some programs, though, a child is not referred until the birthfamily's parental rights are already terminated.

In China a child has to be abandoned for six months before they are adoptable. That pretty much breaks all parental ties. Plus they are generally abandoned anonymously.

We adopted both of our children internationally. We were told that once the child is adopted inside the country, or is on the airplane heading for the US (if the adoption has to be finalized in the US), then the birthfamily can no longer regain custody of the child.

  After the child has been referred to the adoptive parent, the birthmother can still change her mind while the child is residing in the orphanage or foster home, but this is uncommon. Usually many months have passed since before the child is referred.

Added** While the person below me is correct that adoptions can be disrupted, the child is usually placed with another family in the US, or placed in foster care. It is very sad though. I  do know someone who's adopted a child that was previously adopted internationally by another family

**Erin, with Korean adoptions, the adoption is not finalized until several moths after the child has joined their family in the US. Both of our children's finalizations were 6-9 months after they were home with us. Until then, legal custudy is held by the adoption agency in the US. This is much different then most international adoptions though.

you know its how the adption is done. you sometimes can't really tell in foreign country and then their rules and stuff so its also to be very careful get a lawyer that speaks the language and go slowly take care.
