  1. It depends - is the picture on a site where they advertise free graphics?  Technically, downloading any picture from the internet is a violation of the copyright laws because the picture belongs to whomever created it.  However, if it is offered on a free graphics site or if the site contains instructions on how to download a picture and use it for your own use, that could be considered a limited waiver of rights to the picture for the purpose of downloading  only.  

    Whether or not you are making a profit off of the picture, claiming it as your own work or using it in an offensive manner would come into play if the owner of the picture had not intended it for general use by the public.  They would likely consider all of these possibilities before prosecuting.  One could say that because it is difficult if not impossible to protect pictures from being downloaded that anyone who wants their work to be protected should either protect it from right click saving, make sure the picture contains identifying marks showing that it belongs to them or not put it on the internet in the first place.  That does not circumvent your responsibility to make sure the picture is available for free downloading before doing so.

  3. Yes its legal, as long as you don't publish the photo in a way that earns you a profit and as long as you don't claim that you were the person who took the picture or owns the copyright on it.
