Is it ok to leave the US for 10 months w/o receving my Green Card yet?

I was just wondering cause I have to go back to my country for 10 months next year and what if I haven't received my Green Card yet by then. Is it alright? Can I just use my Immigrant Visa? After all, I'll only leave for ten months. Thanks

  1. The first post is correct.

    However, you should notify them of any leave that is more than 6 months but less than a year as well. You should have no real issues leaving the country. If you leave may be more than one year, you need to apply for an extension of leave before you leave the USA. This can be up to 2 years.


  2. Be careful!!!! That can be grounds for them to revoke your  green card.  Green card is like permanent residence status.  You need the I-131.  Check the link:

Technically, you could rely on your receipt and copies of your change of status request, but It is complicated, and you will need to protect your interests.  Even if you had your Green Card, and even with an absence of less than a year, you may be considered to have abandoned your status in the US if you take up residence in another country.  Consider also applying for a Re-Entry Permit.
