Is it or is it NOT Texas Law??

Okay I'm in the middle of an argument with my hubby and his co worker. his co-worker had came back from Germany and returned to work. Before he left he was a Driver at a Lumber yard, and when he came back, he's now a yard worker. The debate is that when he became a yard worker they lowered his pay to the wages of a yard worker since he's no longer driving. my hubby says its Texas Law that its' illegal for them to lower his pay than what it already is. His co worker disagreed that they can do that because he was demoted. Anyone know if its true that they can do that??

  1. Was he in the service?  If he was there are federal laws that govern whether or not he can be demoted while serving.  I think they have to hire him back, but I am not sure if they have to keep his same job for him.

    But, for the most part, if a person is changed from one job to another in the same company the company can raise or lower the pay depending on the position.  It beats being let go if the lower paying position is all that is available.

    I think your hubby is incorrect, it is not illegal.

  3. I don't know about lumber yards. But it would have a lot to do with why he is now a yard worker and not a driver. If he quit when you went to Germany or was demoted because he was not an effective driver, he should be paid the yard worker wage. But if he is a yard worker because there is not enough work for drivers or some other temporary situation, and your husband will sometime soon become a driver again, he would need to be paid what he was as a driver.

    EDIT: If your husband took a job that required less skill and pays less money and he expected to make the same thing he was making a lawyer won't help him.
