  1. yeah..we can get out but the liberals wont let us...the dems rule congress remember..it would be up to them to do it...majority rules

  2. Of course it is possible.  Presuming that country is the USA, The term "juridical" refers to the structure of law that forms the basis of legal status. In this case, the basis for U.S. membership in the United Nations lies in both international treaty and in domestic law. If the United States were to withdraw from membership in the United Nations, action would have to be taken in both areas.

The United States should withdraw from the UN Charter and from the jurisdiction of the International Court of Justice.

The United States should repeal the UN Participation Act, and the UN Headquarters Agreement Act, thereby ceasing to provide any funding, and forcing the United Nations to find a new site for its headquarters. .

The United States should withdraw from the specialized agencies, reorganizing on a private basis any that are found to provide a worthwhile service.

The United States should withdraw from all UN environmental and human rights treaties.

The United States should serve notice that it does not need to ask the UN Security Council for permission to defend itself if attacked.

Once these actions have taken place, the United States will be considered as to have "withdrawn" from the UN.

  3. Wtf do we have to ask permission if we're attacked? That is the most retarded **** I've heard in my life. We should disband the UN and create a new World Organization that has the power to do stuff not just sit around and complain about how the United States is bad. If they think the United States is bad they should invade it. But oh ya...they can only "Peace keep". That wouldn't be Peace keeping eh?

  4. No. The United Nations Charter intentionally contains no privisions for withdrawal, precisely because this was used during the League of Nations as a constant threat and impediment to getting anything done. The only mechanism that would allow a member state to withdraw is the principle of rebus sic stantibus. This would apply only in circumstances where the situation in the member state changed dramatically and justified the withdrawal. In practice, this has never happened.

  5. First, you have to learn how to write.

  6. To be honest there really aren't any provisions a country needs to follow. The UN has shown time and time again that it is incapable of taking any significant actions against opressive regimes or countries that do not follow its international laws. The U.S. would simply have to say "we are out" because who can enforce the UN's laws anyway?

  7. I'm sure its POSSIBLE, but I don't know how they would go about doing so. I'm sure it wouldn't look very good for that country lol

  8. I think that practically speaking, all that need be done is a Country's sovereign Parliament to legislate for it. Then it shall be done because the Parliament is sovereign.

Problems arise if membership of the UN is prescribed for in a country's Constitution but that is only a hypothetical problem. In this case it may be said that Parliament would be acting unconstitutionally in withdrawing from the UN.

But this act of legislation I speak of may not even be necessary - the Executive may unilaterally declare otherwise.

It really depends on what country in question we are discussing and its structure.

Even if there is withdrawal it does not mean that human rights will not be guaranteed. They may be prescribed for in  the country's Constitution, for example, or the courts will ensure they are protected in the common law.
