  1. That would depend on the type of J program you were signed up for. If it's a summer work/travel program, it may not be a problem, but for anything else, your prospective employer would have to already be registerd through the State Department or would have to register and then file the proper paperwork, the DS-2019. Then, you'd either have to go through USCIS or go outside the US and get a new visa.

  2. This depends on how strict your sponsor agency in America is. If the contract you signed with the sponsor states that you must go to the job that you agreed to, which it undoubtedly does, then you need to call your sponsor agency in America before you make your own decision to just not go to your contracted job. Some sponsors will allow this, while many will not. The State Dept rules state that a student may be dropped from the program if they break US State Dept., or the sponsor agency rules.

You need to contact your sponsor and you also need to remember that the J-1 Work and Travel visa is not a tourist visa. You agreed to work a job and that company agreed to sponsor you. Without this agreement you wouldn't have your visa. When you just unilaterally decide to not go to your employer, without even giving the job a chance, the sponsor is justified in removing you from the program.

If you do not show up to work your job, and you haven't contacted the sponsor about this, the sponsor has the right to show your program status as terminated in e US SEVIS system
