How one can be an NRI..Will anyone explain it clearly..

Can we get the status of NRI after marrying with a foreginer...Or what we have to do for that?

  1. The term used for an NRI , being  a person who has gone out of India or who stays outside India for the purpose of employment or carrying on business or vocation outside India or any other circumstances which indicate his intention to stay outside India for an uncertain period.

An Indian Citizen who stays abroad for employment/carrying on business or vocation outside India or stays abroad under circumstances indicating an intention for an uncertain duration of stay abroad is a non-resident. (Persons posted in U.N. Organizations and Officials deputed abroad by Central/State Governments and Public Sector undertakings on temporary assignments are also treated as non-residents). Non –Resident foreign citizens of Indian Origin are treated on par with non-resident Indian Citizens (NRIs) for the purpose of certain facilities.

    Main categories of NRIs

    The following are the main three categories of NRIs:-

    (i) Indian citizens who stay abroad for employment or for carrying on a business or Vocation or any other purpose in circumstances indicating an indefinite period of stay abroad.

    (ii) Indian citizens working abroad on assignment with foreign government agencies like United Nations Organization (UNO), including its affiliates, International Monetary Fund (IMF), World Bank etc.

    (iii) Officials of Central and State Government and Public Sector undertaking deputed abroad on temporary assignments or posted to their offices, including Indian diplomat missions, abroad.

    NRI or non resident Indian has also been defined under the Income Tax Act as an individual who is not in India for 182 days or more during the relevant previous year.  The period of stay is counted in number of days for each financial year beginning from 1st April to 31st March (known as previous year under the Income-tax Act). Secondly an individual who is not in India for 60 days or more during the previous year and he is not in India for 365 days or more during the 4 years prior to the previous year. NRI are also defined under the FEMA, 1999 as Person resident outside India means a person who is not resident in India. Who is a resident? i) a person residing in India for more than one hundred and eighty-two days during the course of the preceding financial year but does not include -

    (A) a person who has gone out of India or who stays outside India, in either case -

    (a) for or on taking up employment outside India, or

    (b) for carrying on outside India a business or vocation outside India, or

    (c) for any other purpose, in such circumstances as would indicate his intention to stay outside India for an uncertain period.

    (B) a person who has come to India or who stays in India, in either case, otherwise than -

    (a) for or on taking up employment in India, or

    (b) for carrying on in India a business or vocation in India, or

    (c) for any other purpose, in such circumstances as would indicate his intention to stay in India for an uncertain period.

    Apart from these any individual who has immigrated to another country & stays more then 182 days away from India will be considered NRI. After marriage with a foreigner you get NRI status only after your stay outside India for more then 182 days. Hope all this information is enough for you!
