Question:

Is it possible to revoke Permanent Residency of a person who was dependant at the time of application?

I had filed for PR on my own then this guy who is now my husband came into my life and i fell in love with him. He then mentioned that it will be a good idea if we both get PR together. I then withdrew my application and we filed together with him as my dependant. Later after 6 months when the case officer was alloted and was asking for documents he came up with the idea to get married. After getting married we submitted to Immigration the certificate and he too got the PR along with me. Then he said we will go to our home country and then we came back to stay with his parents. In 1 month they torchered me so much that i had to leave and move out of the house. Its been 2 months that we are not together.He now says that his parents dont like me so we need to be separated. Its hardly been 4 months of marriage.I have all reasons to believe he married only for PR and now has dumped me as a bin.Please advise if i can let DIMIA know and get his PR revoked.

Report him to immigration.  Make it clear that you now believe that he wanted to marry you only to get permanent residence, because as soon as he got PR, he demanded a separation.  Tell them you are revoking your affidavit of support based upon his defrauding you and filing for an annulment based upon his defrauding you.  Get a divorce attorney immediately, and insist on getting an annulment based on his defrauding you.  Persist until he's booted out!  Any visa, residence, even naturalized citzenship can be revoked on the grounds of the party's commission of marriage fraud!


  2. I'm not sure you can get anyone's PR revoked. If he fooled you and got his residency that way, it sounds like an emotional problem and INS doesn't have time for that. During the days of your marriage and the love you had for him, you decided to help him out... the INS is only concerned when the marriage seems to have been fake...but your marriage wasn't, you really did love the guy.

    I believe the only way he could lose his residency now is if he is caught up doing something illegal... like at a felony level. Or if he tries to scam the IRS and evade taxes.

    Sorry about your situation, it just doesn't sound like the INS will give you what you want based on the proof you have. You might be able to start off in civil court though, they could help you go about it  a different way, I'm sure.
