Technically no because you're not related, but look at it this way: you are "the other woman" to your mom. Your Mom's husband is cheating on her...with you. Plus if you're under 18 it is DEFINATELY illegal.

Yes. especially if her mother is still in the picture. If the step daughter has reached the age of consent and enters the relationship voluntarily, the only potentially legal issue is that she is causing emotional distress by knowingly and recklessly causing a fractured relationship between her mother and step father, which is a highly immoral and unconscionable thing to do. If she is under age it's not only incest, but statutory rape by the step father.

Well, technically it may not be incest because they are not blood relatives, they should be ready to face the consequences if her mother and his wife ever find out about them. It could turn into a less than pleasant situation with her freaking out and wanting either her daughter to leave or her husband or both. Or it could turn kind of kinky with her turning it into a threesome, but I doubt very much this will be her reaction, but then again you never know what will happen now days.
