    People don't always leave a certain amount of tip, so the restaurant has the ability to do what they want.


  2. its not legal nor illegal. say its a custom or some kinda tradition that's been practiced for years and years.

    It ranges from parties of 10-20 people and above and depending on the scale of the restaurant, they can (with hung, written notification or other signage) inform patrons that for parties of this size they will pre-add the gratuity of 15-20%.

    It's put in place to protect the waiters from being stiffed. I was a server, and trust me, there are a lot of pricks out there.

  5. It is legal however it needs to be posted to make the customer aware. then the customer can choose to stay or not.

    Also in some states it is not just large parties.

    It does not guarantee lousy or good service that's another issue.
