Question:

Is it right for an apartment owner to go inside the dwellings?

I live in an apartment building where the owners daughter who is also the property manager walks into peoples apartment without any notice. She will go in and do things, like repair stuff or to "check something out" she only does it when nobody is home nor gives any kind of notice that she will be doing something. I don't think it is right but nor do I know the laws on the situation. She has called me before to go to her apartment and get the keys and let some service guy into another ladies apartment, I don't like doing it because I would not like someone to do it to me? Any input?

  1. Dear Landlord:   When we rented the apartment you gave up the right to full possession of  and access to the premises for a pre-determined time, as long as we comply with the terms of the lease. You have only very limited rights to enter space now in our possession, if you desire to collect the agreed rent money.

    It has become clear that you feel you are unaware of the laws regarding trespass and breach of lease. Should you feel compelled to continue trespassing in our premises, in violation of our property rights and the terms of the lease, we will be forced to take legal action and withhold rent pending further resolution.


  2. I believe that where I live, unless it's an emergency, they must give a 24 hr. notice of entry in writing first and then state the purpose of their entry.

  3. It depends on both the terms of the lease and the laws in your state. Most of the time, though, 24 hour notice is required.

The property manager and/or landlord must give 24 hours notice to enter an apartment for a non-emergency situation.  Once the property manager and/or landlord has given proper notice and you have accepted the notice only then may they enter the apartment.  You also have the right to be present when they need to enter the apartment at a time that is mutual between the parties.

    In an emergency situation, the property manager and/or landlord is still required to contact the tenant to let them know they need to enter.  In some instances the emergency may be so urgent that they are unable to contact you until they have solved the emergency.  Some examples include pipes bursting, fire, if the tenant left the water running and it was causing damage to the apartment and the apartment below.  These are a few examples that I can think of off of the top of my head.

    The property manager and/or landlord is breaking the law by entering the apartment without notice, it is considered trespassing and in some states unlawful entry.  If you care to list the state in which you reside under additional details, I will be more than happy to provide you with the specific statute for your state.  In addition, I will be more than happy to draft a letter for you that you can present to the property manager and/or landlord.

  5. change your locks. The landlord must give you a minimum of 24 hours notice, must get your permission. You can insist on being present, and the visit be during daylight hours.

    Next time she walks into your apartment call the police report a break and enter.
