Is it still considered working if your eating and taking calls at the same time?

In between eating on my "lunch break" and taking phone calls would that still be considered working on the clock? The place I work at doesn't close during the lunch hour and according to one of my boss because we are eating it's technically having lunch, even though we're answering calls and helping customers. Is this legal to not get paid for that time?

  2. no, that's working.  Working needs to be paid.  If you do not get paid, you are not obligated to do any work, or answer phones.  Call the labor board in your state.

  3. That's an easy one. You are working, so legally, you must be paid. Call a lawyer. You and your coworkers should be able to collect back pay, overtime and possible penalties.
