Is it the law to pay vacation pay?

my friend just got fired from her job she has been at for two years-they gave her her final pay however she had 40 hours of vacation-do they have to pay her that?

  1. Some states have laws that it has to be paid - otherwise no.  There is no federal law requiring it.


  2. No, there is no federal law that says a company has to pay out accrued/unused vacation time, it is a company policy. There is no law that says an employer has to give employees paid vacation time.

    Your friend would need to read her company handbook to see what it says in their about their company policy.

  4. Yes. She should get a separate check for the vacation.  I got mine, and so did my husband when he left his job.

    ok, i have just found an article that lists which states have laws that require final vacation time to be paid. if her state is not listed then no, they have no requirements.

It really is a benefit and just like life insurance there are exceptions when it comes to the pay out.  Your company policy is the guiding factor in this.  Some employers do this automatically. others have to be prodded. File a complaint with your labor department and see where it goes the worst that can happen is you won't get it.    

  9. Yes they do. It is not a "benefit" it is time she earned by working there. Personal & sometimes sick pay is a different story.

    They do not have to pay for sick time, just official vacation.

  11. Depends on the state and how the employer accounts for the vacation.  You can always go to the state Wage and Hour Division of the Department of Labor and they will find out for you, although it will take awhile.
