  5. They are allowed to wake you up, but many are reluctant to actually touch you, as this could be construed as assault.

    Although this might be annoying, one of the reasons is that during the course of a long journey, different conductors will take over en-route.

    The conductors job is made more difficult by people who pretend to be asleep to avoid buying a ticket.  These fraudsters are the ones you should be really blaming for being woken up.

  6. A train is NOT a hotel, sleeping (or feigning sleep) would not get your out of producing a ticket.

    Just that these days we are not allowed to even attempt to arrest you in case we get done for assult or we get assulted so that side of things is left to the BTP.

  8. Untrue. You are on thier property (proerty of the TOC/or former BRB). They may wake you at any time. Ask at your local booking office for a copy of the conditiond of carriage. All is held within.

    it certainly is a bummer, but sometimes you can get away with it and they won't as kyou that happend to me too.

  13. Nope!  They are ALLOWED to wake you up whenever they want!

  14. The guard has to be careful how he wakes you up, for instance if he shook you, you could consider it assault but there is no law saying he can't wake you up. And in fact it is his job to ensure everyone on the train has a ticket so for him to fulfil his obligation to his employers he has to wake you up!!

  15. don't think so. I was woken by the guard on my way home from Waterloo on Saturday night. I think it's only illegal if he violates you. Even then it's probably only frowned upon.

Any employee of the railway is allowed to wake you up as part of the care policy, to ensure you are not under the influence of drugs, narcotics or alcohol, you are alright, to check your tickets and the best one to tell you your over 50 miles from home, the last trains gone and its going to cost you £100 pounds to get home by taxi, because the stations closing and you have to get out.
