  1. No, it's whatever the two companies agree to.

    This is one of those "myths" that the Personal Injury lawyers like

    to out at injured people so the injured person gets sucked into going to the lawyers dr. That way they "pad" the amount of the medical bills and the injured person thinks they will get rich, when in reality the lawyer is the only one who gets rich.

    In every state I have handled injury claims in it is illegal to determine the value of an injury claim using a 3X formula.

  4. No.  There is no formula for settlement of "pain and suffering" by any insurance company, and each case is heard on its own merit.

    Your best source of information about your particular case will be your insurance agent.

  5. Each insurance company provides stipulations to it's adjusters.  There is no set formula for settlements.
