Is it true that early termination fees are illegal in California?

I read it in this article:

I want to cancel my contract with tmobile because their services are horrible and all of the calls are constantly dropped. Also, everytime I call them, I am always on hold for about 10-15 minutes and then my call gets disconnected.

If early termination fees are illegal, what should I say when I tell them when I want to cancel my contract?

I did hear in the news that California just outlawed early cancellation fees.  I did not hear when this law will go into effect.  Before you talk to the mobile company, check out out when the law goes into effect.  Then call them on a land line so that you don't get disconnected.  Just tell them that you no longer want to be bound to a contract.  


  2. Technically, a court's decision is only binding upon the parties present. But hey, everyone is a moron and they'll ignore this fact.

    Once a court's decision is made, it's set into place. Tmobile can't charge you and if they do, then you can file suit against them. However, I know Sprint (if memory serves) was filing for an Appeal. So if the Appellate Courts reverse the decision then they can start charging again.
