I'm sure it depends on the state, but I've never heard that particular one.  If it's an open empty bottle, yes.

In my state, if you are drunk and you go to sleep in your car and have your car keys in your pocket or even in the glove box, you can get arrested for DUI, if you drop your keys outside the car before you fall asleep, you can't.

Look up your state laws.
