    If a person is working, and the income is being paid "under the table", without deductions for income or payroll tax, he/she is breaking the law. It's called income tax evasion. It is also illegal for the employer to pay this way.

    If a person is doing contract work, without being an employee, he/she is still required to pay income taxes and FICA tax. If the total income is not reported, and the IRS catches up with it, that person could be charged with tax evasion.
