Is it unfair dismissal sacked friday,worked all following week

hi,i worked for a holiday park full time for over a yr in uk,loved the job but on a friday afternoon they called me in office and said i was being dismissed for dishonesty which is aload of rubbish,anyway boss asked me to go home and think about if i wanted the job,which i thought was a stupid question,then monday i went in as usual and the boss said he wanted to go forward not backwards and so he said to forget about what has happened,which again thought strange,then i worked all week,nothing else said,then again monday morning went in said gd morning,he turned round and said i not happy,i asked whats wrong and he said to get my things and go home as i was sacked,i asked why and he said being dishonest,which i deny as a load of rubbish,but can someone advise me what to do,as this is stressing me and partner,i had some issues on there safety for which i kept having a word with them about,main reason was a digger bucket was dropped on my foot,only a foot high[odd job person having probs so i helped him change bucket,but never noticed he got in digger to drop arm]my boots stopped injury,but had a word with boss,and he said not to mention it to the safety representive of the holiday park,i didnt do anything as loved job,hours etc.

where would i stand if i took this further,your help would be great,thanks

  1. Take him to an Employment tribunal for Unfair Dismissal.You have a good case.

    He needs to validate his allegation of dishonesty.

    You were not taken through any investigation to substantiate his allegation therefore there is no allegation.

    You were given no notice also  which is a statutory right.

    To be sacked in the manner he has done indicates Gross misconduct which means there has to be a record of this.

    Here is a letter I would write to him.

    Dear Mr Bloggs

    I have been in your employment at Bloggs holiday camp from ..... to ..... a period of 12 months.

    On ..... you called me into your office and told me I was sacked.

    As is my right I have been advised to raise this matter through the Employment tribunals procedure and require from you the following.

    1. A letter indicating why I was sacked?

    2.What notice you denied me to work and the reasons why?

    3.All correspondence or notes you have in your possesion under the  

       Data protection Act 1998 in regard to any allegations against me    

       which resulted in your decision to terminate my employment.I

       require these documents for my advisors.

    Put an envelope in for this to be sent back to you and pay for the recorded delivery and make sure you record the letter to him marked for his attention only.

    Don't go into detail or make the letter appear personal and also make sure you recieve any holiday pay you are entitled too.

    You can also ask for a meeting to discuss the matter i.e reinstatement but take a witness.

  2. ask the odd job man if he'll back up a statement  - and go to the citizensadvice bureau and get see what they say  - sounds like constructive dismissal to me

  4. It all depends on the laws were you live. I live in the US, and in an at will employment state. This means they don't even have to give me a reason why they are firing me, just that they don't need me anymore. Makes trying to get unemployment very interesting! Check out the labor laws in your area, there should be a number you could call to talk to someone. I would ask for an explanation of what exactly you were being dishonest about, you have the right to know what they are accussing you of lying about.
