you are making a left turn from your drive way, you see a car coming from your left (300 feet away) you still turned. as you you are finishing your turn (already over the dotted yellow line) you get struck by the other car. hitting you on the back passenger side. is it totally your fault? should the other car of slowed down? it was a 25 mph road. could you of made it? could the other car be speeding?

  1. Yes it is your fault especially with no witnesses that said;" the other driver sped up and crossed the yellow line and tried to kill him(you)!"

    The Police/law see the situation as they see it and know you pulled out and created the crash. Turning out or in front of another car or slowing it down; is always your fault!

    So don't take the risk next time and count it as experience.

    Wait until it is clear and know if you were in the other drivers situation; someone will try to pull out on you!


  2. Sounds to me like both cars are being operated by bad drivers.

    The first driver could have waited two more seconds before turning and the second driver could have slowed down.

    They both have poor judgment or are just not paying attention. I hope they both learned a lesson.

  3. The other car hit you on the back side?? It's his/her fault entirely. Anytime anyone hits you from behind, they are 100% at fault. Why? Because they were not in complete control of their car. You were making the turn and hit from behind while in movement, which is a worse charge for them too. I hope you got a police report and their insurance information too. Ask any police officer and they will tell you it's true.

    Let's evaluate here, shall we?  One car is in a private driveway, the other on a public road.  Who would you think has the right of way?  What would the law say?  The car on the public road must slow down at every private drive to make sure no one is pulling out, or perhaps the person leaving private property must yield to traffic on the road?

    Now all of you maintaining "He hit you from the rear, it's his fault", read the question again.  "...hitting you on the back PASSENGER SIDE..."  That indicates the car coming from the left hit the rear of the car pulling out as it was (let me quote again)  "...finishing (the) turn..."

    Yes, since you pulled out in front of a car coming from you left and he hit you in the passenger side since you didn't wait until the road was clear to start your left turn from private property, YOU, not the car that hit you, are at fault.  Notify your insurance you caused an accident, and they will pay.

  5. The other driver had the right of way. A person turning left NEVER has the right of way unless they have a left turn only green signal. It doesn't matter how fast the other car was going - you failed to yield. You are at fault.

  6. Not your fault. You had almost completed making the turn and the other guy failed to slow down and struck you from behind. In nearly 99.9% of rear end crash cases, the driver of the car that reaer ended the other car is at fault for not being in complete, control of their vehicle. You have a solid case. Also, did you obtain a police report?

    Edit: to clarify, you were hit as you completed the turn, therefore, the driver of the other car hit you while moving which is a worse offense/violation.  No matter what, the other driver was going straight and was negligent for rear ending you. They should have been looking and slowed down to let you complete the turn. Meaning, you had the right of way and they failed to yield. Also, since you were competing the turn,  the other driver obviously had enough time to react and slow down and stay in control of their car.  Check the and know the law. You are NOT at fault. Get an attorney if you haven't already.

  8. Your question does not make sense! If you are turning left and the car is coming from the left, how did the car hit you in the passenger side? Unless you are in an area with right hand drive, I am confused.

    Under normal circumstances, if you are still making your turn and you are hit, it is your fault. It does not matter if the car that had the right of way was speeding, if you pull in front of him you are the cause of the accident!

    If you made the turn completely and then were hit in the rear (not the side) then the driver of the striking vehicle is at fault for failure to reduce speed to avoid a collision! You would have to have established yourself in the travel lane, and then been hit!

    From the way you describe the accident, you are at fault!
