  1. No it is not. You need to read the fine print. If it says if is CARFAX certified and it is not then yes that is illegal. A dealership can have a mechanic check and car and claim it as a clear with no problems. Then the dealership slaps the certified sticker on it.

    yes - of course.  Who would FORCE the dealers to use CarFax and and what conditions of CarFax report would fail or pass a "certification"?
