    Immigration Marriage Fraud Amendments of 1986

    Public Law 99-639 (Act of 11/10/86), which was passed in order to deter immigration-related marriage fraud. Its major provision stipulates that aliens deriving their immigrant status based on a marriage of less than two years are conditional immigrants. To remove their conditional status the immigrants must apply at an U.S. Citizenship and Immigration Services office during the 90-day period before their second-year anniversary of receiving conditional status. If the aliens cannot show that the marriage through which the status was obtained was and is a valid one, their conditional immigrant status may be terminated and they may become deportable.

    3) In order to rebut the presumption of a fraudulent prior marriage set forth in section 204(a)(2)(A) of the Act, the petitioner has the burden of establishing by clear and convincing evidence that the prior marriage was not entered into for the purpose of evading any provision of the immigration laws.

    (4) The clear and convincing standard of proof, which requires more than the preponderance of the evidence standard but less than the beyond a reasonable doubt standard, is that degree of proof, though not necessarily conclusive, which will produce in the mind of the trier of fact a firm belief or conviction.

  2. That is a marriage fraud. if proven, you may go to prison for not less than 5 years or may be fined not less than 250, 000 or both. Although it is hard to prove a fraud marriage, you should always make a second thought for its illegal.

  6. Yes.  it's called MARRIAGE FRAUD.  You can (and should) go to prison for it for up to 10 years and pay a $250,000 fine.

  8. If you live with that person..... no biggie. But it takes more even if so.

    But to just do a business deal? Here are some of the ways they catch people (and they do random audits). Most people doing this sort of thing don't live together. Even if they do they look at many things.

    Money is the big thing as if someone who is trying to make a few bucks won't cover this. If one is honest it would naturally happen. If one is married one just makes the other a benificiary for life insurance. A contact number listed at work if there was an emergency. When you open a bank account you list this as well. Day to day bank accounts you at least have one so your other is taken care of.

    I know lots of people who are doing the right thing...... but sometimes it even comes down to having family pictures over a period of time. Showing that you are a family. Not posed but real as one can tell. There are many ways that they can tell it was marriage for a visa.

    Usually the person gets deported and can never apply for another one..... ever. The person who was the citizen..... they night not get jail but it will cost far more than what they got out of the deal.

    Your marriage should be based on trust, love and common understanding, not on a piece of paper. The only situation where a marriage like this kind can be justified if it's saving you from a very poor situation, maybe starvation. Otherwise you should have enough human dignity not to sell yourself.
