Question:

Is my Drivers license going to be suspended?

I was pulled over by a Illinois state police. He gave me six tickets-speeding over 20, no turning signal, following up closely, improper displacement of license plates, tinted license plate cover, wrong address on DL. The tickets say that I don't have to go to court. He took my DL as a bond. Is possible that my DL can get suspended? AM 20 yrs old. The state officer did not mentioned anything about suspension.

  1. It is very possible that your driver's license may be suspended, and I don't know why he took your license, so now you are driving w/o a valid driver's license.

You need to check with Illinois to see if they have a "diversionary program" for first offenders.

This may allow you have these charges removed as you complete their program and you will retain a clean license.

    Good luck.

  2. You are not likely to get a suspension because

the Illinois Administrative Code provides for suspension for three or more convictions within one year.  I have not been able to determine whether each violation is considered a separate conviction however the speeding over 20, the no turn signal and following too closely are the only violations that could be considered for points.  The tinted license plate cover, improper display and wrong address are not pointable moving violations.  I believe the suspension would be considered discretionary and as long as you pay your fees consisting of fines, court costs and/or bond you should be OK. Please be advised however, I'm not an attorney and I'm from Ohio

and could be mistaken with probability of 1/20.

I'm 95% sure you are OK, which means most people I know would assert that you are without the caveats.    I would want to determine, if I had more time, if Illinois considers each traffic stop with all violations included as ONE conviction or

if each conviction is considered separately.   My hunch is that the law does not specify it and allows a judge or DMV official to intrepret.   The fact that your enforcement officer made no mention of possible suspension is also a good sign, law enforcement have to go to workshops to keep them informed of current law and policies in their own jurisdictions.

  3. Be d**n sure and get the license plates in their proper place and remove the cover. and fix the dl address before your court date. they are basically fix it tickets and if you take care of them BEFORE your court date, and have an officer sign off they are fixed, you will only have to pay a small fine, otherwise you will have to pay the whole ticket, and you will look irresponsible to the judge.

your moving violations are the speeding, not using your turn signal, and tailgating. for those plead no contest and get traffic school. if you dont go to traffic school your insurance is going to hit the roof.

When you got the no signaling ticket did the officer check they were working? You might claim the bulb was burned out and you thought they were working, and have an officer check it after you "replace the bulb" and verify they are now working.

you are not going to lose your license, but your insurance might go up, especially since you are young

  4. Get a lawyer.  He might be able to suspend few of the tickets until the points expire on the other.  As long as you don't have CONVICTION (and 11 or 12 points) all at the same time, you do not get a suspension.

But it might be cheaper to take the suspension - instead of paying the lawyer few hundred dollars - few times a year to postpone the court dates.

    Good Luck...
