Is my RockBand drum set eligible to be replaced?

I have a RockBand drum set for the Xbox360. I put the silencer pads on the drum pads, and still my yellow pad got cracked. Is this eligible for an Xbox360 replacement? Also, my drum pedal broke a while back, and it's missing the top piece. Will they send me a new one if I just send back what I have?

It all depends on when you got it

The manufactures warranty covers it for one year if its been less then that...yes you do qualify for the replacement on both items
