Is my brother unethical, should I take legal advice.

Our families estranged brother and fathers son was nominated as the executor. His ability not to co-operate with other members of the family has put an enormous stress on everyone. We agreed to use the RRSP'S my father left to all of us as monies to pay off any funeral expenses, income taxes and any liabilities. My father had to money of his own. All has been paid and he still will not distribute remaining balances to myself and other two siblings. We did not agree to use this type account and recommended we have another name on the account so, he would not have sole control of OUR MONEY. He has a shady past and never got along with my father. Our emotions took the best of the siblings and entrusted in him. He has put a number of assets in his name without telling us and he has still to put one property in our names.He wanted control of this property in case we should sell instead of letting all of us to partake in this. Could you tell me my legal rights and if he has a time frame to complete these tasks. He is just apparently waiting for a piece of paper stating that no other monies are owned to the government. I have explained to him if such arises he needs to TRUST US NOW TO PAY FOR FURTHER EXPENSES that arise and release our money from his personal bank account. It has been one year at end of August.

  1. if you want  legal advice that represents your interests in a dispute, then you will have to hire a licensed attorney in your state to do that.


  2. The probate court can ensure the proper distribution of the estate.  But only if you object or demand an accounting or take some sort of action.
