Our month-to-month rental agreement (which WE typed, and had signed) states our rental period is the 10th of every month, which began on April 5. However, the signed contract is actually dated April 30.

Yes, we moved in & lived a full 3 weeks before actually having all parties sign the agreement. Does this nullify our contract because of the lapsing dates? Or not.

  1. no why would it?

    even if it is not in there, you'd have a hard time proving there is no implied separability clause, which is what you would need to do to argue the entire contract is void if any part of it is.

    not that any part of it is, based on what you said.


  2. I don't think so. Agreements can be retrospective.
