Is my employer required to give me sick days?

Before you answer, I work for a bank. I will not disclose which bank. I have vacation and sick hours given to me on a monthly basis. They show up on my paycheck, how many hours I've accumulated and everything. 2 of my co-workers seem to have no problem whatsoever calling out even on the busiest of days. Yet another co-worker and I can never get a sick day, whether it be called in a few days in advance or a few hours before. I feel this is unfair, especially since they told us we have that right. Can an employer tell us No if we request it? Can we get fired for refusing to come in?

  1. Sick days are for illness, so you can't schedule them in advance -- you'd better be sick and able to prove it.  Also, have you worked there long enough to accrue full days for sick days?  And are you on probation?  Probationary employees take a day off at their peril.

Currently, there are no state or federal laws that mandate sick leave pay.  (Though there's some legislation pending.)  So, basically, whether they offer or pay it is strictly voluntary for employers, unless the terms are outlined in a contract, either with the individual employees, or with a union.  Most companies require an employee use vacation time in order to be paid for scheduled days off, such as doctor or dental appointments.  Check with your union rep, or call the corporate office for more information on your contract.

    Complain to the corporate office if you feel you're being singled-out for unfair treatment.
