my employer take half a hour out of my check for every day i work . im in the valet /hotel industry. im the only valet on the job during my shift. i am allowed to eat when ever i want. but im always on call. so say i sit down to eat my lunch and they need help wit luggage/a car/ a taxi/ or any other issue they need my help with . i must drop my lunch and go return to work so the way i see it i never get a full half hour to myself. im always on call to there needs. but im still looseing the half hour pay. is that completley legal?

  1. Probably depends on the State, In california I know that's not legal that's why a lot of companies make you leave your work area to take your lunch so it's clear you are on lunch.

  2. If they are taking the pay anyway then you must be off the clock and away from your duties during a full 30 minutes not necessarily all at once. If you are working during this time then you need to be paid for it.

  3. They are required to give you half an hour lunch and take it out of your pay. You should tell your employer that you need the time and should not be on call during that time.
