Is my ex-wife's new husbands income included with her's if I need to get my child support adjusted?

My ex-wife is an RN, and our 2 kids lives with her. She remarried 2 months after the divorce, and since then she has cut her time back at work to nearly nothing. I make somewhat less and also pay for their health,dental and vision insurance. Any little bit of adjustment would help. The amount I have to pay is enormous, and she has his help, and then lowers her hours at work because she knows she can depend on his money. Also, if I go to have it re-adjusted, will it hurt me worse now that she has cut her hours?

  1. I thought Child suppor was based on your YOUR income not hers. You set the amount when you divorced. It doesn't matter if she makes nothing or makes 1 million a year.  


  2. child support is based on your income so how much money she has doesn't matter.. you can ask for a cut but you probably won't get it.. the judge will say.. those are your kids not the new husbands you are financially responsible

  3. child support is a set percentage based on number of kids and no matter what, will not be adjusted.  alimony on the other hand should stop once she got remarried.  

  4. Actually, it depends on your state but here in FL it's based upon both incomes as well as the number of overnights visit with the non-custodial parent.

    With that said, she's capable to work 40+ hours and her CHOICE to cut back on hours should not affect your child support. But that's not to say it won't. I have the same concern for our situtation and have been told that because my husband's ex has always held a full time job, a judge COULD give her 60 days to find a job being that she's perfectly capable.

    Typically, the other spouse is not considered with regards to child support.

    I suggest you talk to a lawyer and see what they tell you. Or can you google the child support calculator for your state (if you hvae one).

  5. so try to go for shared parenting, and it will cut down what u have to pay.

  6. Child support goes to the one that is keeping the children the majority of the time!  Why not have equal custody and no child support?  OR if you would like to be paid child support why don't you get full custody?

    The truth is your wife is probably the better care giver and that is why she has custody and that is why you pay child support right?????

    Get over the bitterness of her new husband, you probably screwed up your marriage right?

  7. Yes its only figured on her income but here its figured on potential income so people cant do that to the other parent. I would leave it alone I think;-)

  9. Child support has nothing to do with her or her husbands income! Just yours! She could be a millionaire and you still has to pay the same amount of child support.
