hi! here is my friend's situation, my friend and her US based husband got married on Oct. 06, 2003 in my friend's country but her husband is not yet a US citizen but then after a month w/c is Nov 12, 2003, her husband got his citizenship through naturalization. Her husband petitioned her last 2004 and my friend arrived here in US on Oct. 11,2005. They are still living now together with their kid. Based on the guide, you can apply 90 days prior to your 3rd or 5th year based on your green card so is she eligible for naturalization based on 3 yrs. residency and married to the same guy though the guy became citizen only after a month of being married...???

  1. When was your friend's green card issued?  It was not issued when she entered in October 2005.  So she is not eligible yet.  She must have the green card for 3 years before she can apply.
