Is my license suspended?

I was driving without insurance. However, if you are caught w/o insurance will your license be suspended?

Also,

When I go to face the judge, what will the judge make me do? File for SR-22?

  1. Get insurance before your court date. Show proof to the judge. Should also be a fine.


  2. Without knowing what state you live in, I can not direct you to the proper web site.  I don't know if your license is suspended, but according to the charge, it can be.   You may have to apply for SR22 insurance.

I can only answer for the state of California as it is all that I am familiar with and the answer to the question if this did happen in california is this: If you get into an accident without insurance you would be required to file an sr-1p filing which is basically the same thing as an sr22. When you do go to face the judge the most important thing for you to do would be to show them that you do have a valid insurance policy. If you do not show up to court on your appointed court date your license will be suspended for failure to appear.  Whatever you do dont go in to the judge with no current insurance policy the fines are frequently doubled

  5. I believe you received a violation of CVC 16028, correct?  That is an infraction but it has a huge fine...about $1600.  If you bring proof of insurance to court, that is your best chance of getting out of this fine.  If you cannot get insurance by your court date, request a continuance.

    If you had a valid drivers license when stopped, NO, your CDL will not be suspended.  But simply call DMV if you are not sure.  Also, there are no DMV points for this offense.
