Is my neibor's homeowners policy responsible for this?

I live in a townhome and we have wooden back doors close to our public parking lot, and in order to park my car i have to get close to the wooden back fence doors for good a good angle.

yesterday was really windy and as i was parking my car my neibors unclosed door just opend up cuz of the wind and hit my car. will my neibors homeowners policy cover for this? i mean i dont want to have to fight with my neibor...

Unfortunately homeowners will not cover that.  You would have to prove that is was on purpose that it hit your car.  I have called our underwriters about this except it was patio furnture that the wind threw into the neighbors yard and did damage...  You would have to file that under your comprehensive coverage and pay the deductible.  Sorry


  2. If the wooden fence belongs to your neighbor and the wind is what made the fence fall on your car, then yes he is liable for the damages done to your vehicle. I would let him know but approach him nicely and let him know what happened as soon as possible because he may dispute that you hit the fence, causing it to fall on your car. You will want to get his address, name, insurance information. But if you do not feel comfortable doing so, you can contact your Auto Insurance carrier and file a claim there. It will be a Comprehensive claim and if you have the coverage on your policy, your policy will cover the damages. The only thing you will be held responsible for is your deductible. Then your company may include it to their payment demands  (subrogation) to your neighbor's insurance carrier and you may get reimbursed for your deductible. The only problem is how long your neighbor's insurance will take in paying back your deductible.

  3. It would only cover it if you could prove it was his fault. I am not seeing a lot of fault on his part so am I thinking it will not be covered.
