Is my roommate responsible for the rent even if she doesnt sign the lease?

Me and my roommate filled out an app. 4 an apart.roommate never signed lease or filled it out, but the landlord asked me 4 her name and job info. 2 put on the lease where it say business address and name of nearest relative, i and the landlord signed where it says this is an lease agreement between i and the landlord , and it says occupied by 2 adults and one child which is me my roommate and my child,however my roommate never signed the lease, can the landlord sue her for non-payment of rent.

  1. You signed the lease so you are responsible not only for the rent each month but when you move for the way you leave the apartment.  If there is any damage the landlord can come after you for repairs/payment and not your roommate even if she is responsible for it.


  2. If your roommate never signed, I don't think she is responsible.

    BUT, because your name is on the lease, you could kick her out. Just give her a "1 month notice", then, if she doesn't move, you could call the coppers.

  4. No, she can't. In fact, even if she DID sign the lease, you are the other person on there, and if the landlord can't get any money out of the deadbeat roommate, you are going to be responsible for the full amount of the rent. This happened to me in college. I got an apartment with a friend. She quit school about half way through the school year. I called the landlord who told me that I was just responsible for my half and not to worry about it. Unfortunately I didn't get that in writing, because by the end of the school year I got a letter from a lawyer saying that I owed all of my deadbeat roommates unpaid rent. Apparently they tried to get the money out of her, but her parents refused to pay it, so they came after me, and in the state of Wisconsin (where I went to school), that's the way it works.

    But again, since she's just listed as an emergency contact, then there is no binding agreement between her and the landlord, just you.

  5. If she is living there he may be able to sue her. I am not completely sure about that but I know if she doesn't sign the lease he can kick her out and he doesn't have to give her any certain time before she must be out. Leases are as much to protect the tenant as the landlord. If she isn't paying the rent you can kick her out because it is your apartment not hers. The mere fact that she is living there implies that she will pay the rent. She cannot expect to be allowed to live somewhere and not pay the rent.
