Is my work situation a wrongful termination?

I have been working as a computer technician for the this city. I have been working their for 6months and never missed a day of work. Never been written up for anything either. To sum it up i was a great technician.

I was fires yesterday because my boss heard me call him a "bi*ch a*s ****a." I was calling his cell phone from my cell but he never answered his phone. I had forgot to hang up my phone and this is when his phone recorded what i had said.

yesterday after work i was fired. i was not givin no papers to sign no nothing but my check that i have to pick up on tuesday. I have read our companies handbook and it stated "that an exit interview may be scheduled." i was basically told that i was terminated, give us our stuff back and get out. it this illegal? please reply

  1. Oh Boy!!! Yep! I am sorry, but they can fire you for that!  Bad move eh! but, it's too late to worry about it now! Just keep your mouth shut next time you use your cell phone!!! My advise to you is, when you apply for another job, be honest with them, cos if you don't it could come back and bite you on the butt! Tell them you screwed up, and if they are human beings, they will appreciate your honesty!!! One thing I don't understand is though! why were you using your cell phone on the job to call your boss!? Don't they have regular phones?  You WERE at work? Right!? I am sure he's been called those names before!

An exit interview is just a survey that HR gives you asking why you are leaving, its mostly for people who turn in a two weeks notice not really for people who get fired.  It depends on what the laws are in your state as to what they need to fire you. I live in Oklahoma and the law here is that they can fire you for whatever reason they want, they dont really need a reason.  But you gave them a reason to fire you.

The key word is "may be schedule", just a lesson learn in life and with a cell phone.  Not to be mean, using FOUL language to/about/with your superior is just uncalled for.  Wrongful termination, well they have proof; and if they were to give your position back to you, would you work there (hostility)? Just don't put that on your resume!

  5. totally legal. when you get hired and sing the application, you agree that employment is "at will", meaning you can leave the compant at any time for any reason with or eithout nitice, just as they can let you go at any time for any reason. bad mouthing the boss, thats good enough for dismissal

    the recipient of any foul language doesn't need to hear what's said to justify action taken against you-other people hearing what you said is good enough.

    I have to deal with folks like you all the time, eventually I have to escalate every routine matter to someone who really knows what they are saying.

    total waste of time, but if you can turn on a computer there will always be a support position available to you. all you need to do is write any bs and hope the customer doesn't know any better, to be considered "great".

  9. It was justifiable termination for using inappropriate language in the business setting and could be considered racist.

    An exit interview in many cases is only done when an employee voluntarily leaves their position, not when they are terminated.

    Chalk it up to a lesson learned the hard way on your part and when you get a new job, watch your behavior and language.

  10. an exit interview may be scheduled.  doesnt have to be and apparently it wasnt.  they can fire you for anything that they dont want and they will have lawyers that will come up with some reason as to why you were fired in fine print of some contract
