It's not so much legal or illegal, it's currently unregulated like other new technologies. The federal law is about how banks interact with gambling sites, but it doesn't affect individuals directly.

The way the US is set up, each state makes it's own laws. For example, prostitution is illegal in 49 states because 49 states passed laws against prostitution, the same with drinking age.

Everything on the Internet is almost impossible to regulate, since almost all interactions occur in more than one state.

There is no federal law that prohibits online gambling in the US.  There are limitations to the way financial institutions transact with online gambling sites, yet it is unregulated.  It is illegal to house an online gambling site in the US, but not to gamble.
