  1. It's an implied power, as neither form of transportation had been invented at the time the constitution was adopted.  Regulation of Interstate commerce is an expressed power, and airplanes and railroads both participate in Interstate commerce.

    Regulatory authority in commerce is an express power granted to the congress and the president by the constitution.

    Much of the way such authority is exercised in the US nowadays is the result of implications derived from the political atmosphere.
