it's legal everywhere, as far as i know. you can find it growing wild in the mountains of northern california where is we used to get it. doesn't work so great though, very mild hallucinations. try mushrooms instead or half a bottle of nutmeg with orange juice - so long as you're NOT on any MAOi's in which case the nutmeg will KILL YOU!
