depends where u live...here in NC it is...only way u can resell tickets is for face value..of course im sure it still happens..especially for Duke and UNC basketball seats

Depends on where you live, and how you define "scalping".

Buying or selling tickets at or below face value is not usually considered "scalping" by the law. Seeling tickets at higher than face value often is considered as such.

Re-selling tickets (whether at more or less than face value) is legal is over 30 US states.

Actually, scalping tickets is legal in 33 states. I believe Florida was the latest to join the group, in July of 2006.

Yes, you cannot resell a ticket that is illegal in all 50 states in America, and you would be sentenced with a heavy fine of the ticket + 2,500, or two days in jail on you're first time getting cuaght.
