if she leaves my kids in the apartment to smoke pot next door and on another night she had a couple of drinks and then drove with them in the car then the same night she left them with a stranger to watch which was not in the apartment any she was at another apartment drinking?

Yes, especially if the kids are real young.  Hey, your kids should come first.  You shouldn't dump them to get high or put their lives at risk even in the slightest way.  Yea, that to me seems pretty unfit.  left them with a stranger?  Someone in our area did that once.  She handed her baby to a guy at the bus stop so she could run home and get her purse.  She returned and the guy and her baby were gone.  The found the baby dead 3 days later.  That is an extreme case, but when you put your kids at risk, anything can happen and you cannot control it.

The rules vary from state to state.

In most states, it is legal for a 12 year old to be left with younger siblings.

If the children are all younger than that, you should call The local Department of Human Services (or your states equivalent.)

Do not focus on what you believe she is doing when she leaves them alone.  You in fact, assume she is smoking pot, unless you were there with her you do not know what she was doing.

If she is smoking pot, and the children can be safely (and legally) left alone, it is probably better that she goes someplace else to smoke, rather than smoke in front of the children.

You should not be pumping your kids for this information.  Even if you are able to wrest custody from her, it is in their best interest for them to see their mother in the most positive light.

This is definitely neglectful and illegal behavior.  If it was an isolated incident, then it will be difficult to have a court declare her unfit, but if it is part of a regular pattern, then that is easier.

Why are you leaving your kids with this woman?  Kick her out and take care of your kids.

No one should do that to children. What that mother does in her own time is her business but when it effects other people or puts thier life at risk then its wrong and i would say yes maybe she is unfit going by what you have said.
