Is shooting someone with a BB gun illegal?

My cousin has a BB gun & he always tries to shoot us with it, and he tries to get his neighbors with it too... is it illegal?

Yes.  At a minimum it is a battery, like hitting someone.  It could be battery with a weapon, depending on the law of your jurisdiction.

While its not right to shoot anyone with any type of gun, I don't think it is illegal. It may be in some states though.

From a lawyer.  It is called simple assault.  It is not assault with a deadly weapon.  It's assault even if you just touch someone offensively.  BB guns hurt and it is definitely assault.  Call the police and they will sort out whether it's juvie or adult.

if you call the cops ob your own cousin they will probably tell you it was a prank and let him off with a warning but if he shoots the neighbors he could be in bigger trouble.

sounds like poor responsibility on his part and his parents for allowing it to continue.

Assault with intent to maim is one.  The other is brandishing.

you can charged with brandishing a weapon if a toy water pistol looks real.  If the boy is in his yard and shoots, he is presenting a probability of danger to his neighbors.  Unless he can demonstrate a clear level of competency, he can be arrested.  

In VA, he cannot even attempt to shoot at animals because a 22 cal weapon is the minimum cal alowed.

The next time you cousin tries to shoot you, tell his parents.  If his parents do nothing, they are obviously not fit.  Tell the authorities because no one else is going to protect you.

I have my daughters recite the first six rules of safety.

1.  treat every weapon as if it is loaded.

2.  Do not point the weapon at anyone unlless you are willing to have them die.

3.  identify your target.

4. Id what is behind your target.

5.  Do not put your finger on the trigger untill you are ready to fire.

6..  Never trust your safety.

rule no. 7.  If someone points a weapon at you, remember rules 1 and 2 and shoot in self defense

Yes, it is considered assault.  People have been blinded by bb guns.  Talk to his parents, and if that doesn't help, call the police.

....a side note.  i have a BB rifle in the house for the squirrel that lives in my eaves...i have tried to block him, but he keeps coming back.  I seen him running across the trees in my hard, and i popped him with the gun.  i run out there to make sure hes dead, so my wife and 4 kids are in the window with the gun

my wife waits till i bend over to pick up the squirrel, and she literally shot me right in the b******e....thank god i had jeans on.  it hurt like an SOB

everyone in the house was laughing their rears off...all i could think about was..what a bulls eye.
